1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of tubetrends (the "Service"), operated by CoStudio Pte Ltd ("we", "us", or "our"), a company registered in Singapore. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and "you" refers to both you personally and that organisation.
2. The service
tubetrends provides market-intelligence signals derived from publicly available YouTube data, delivered as briefs, dashboards, exports, and related interfaces. We may add, modify, or remove features at any time. We may also impose usage limits, require additional terms for certain features, or suspend the Service for maintenance.
3. Accounts
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@tubetrends.ai if you suspect unauthorised access. You must provide accurate information when creating an account and keep it up to date.
4. Acceptable use
You agree not to:
- use the Service in any way that violates applicable law or these Terms;
- reverse-engineer, decompile, or attempt to extract the source code of the Service;
- resell, sublicense, or otherwise commercially exploit the Service without our written consent;
- use automated means (scrapers, bots, crawlers) to access the Service beyond what we expressly permit;
- interfere with the Service or attempt to gain unauthorised access to any systems or accounts;
- use the Service to transmit malware, spam, or unlawful content.
5. Intellectual property
The Service, including all software, content, analyses, scoring models, and visual design, is owned by CoStudio Pte Ltd or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes during your subscription term.
Nothing in these Terms transfers any intellectual-property rights to you. You may not use our name, logo, or trademarks without our prior written consent.
6. Your content and data
You retain ownership of any content or data you submit to the Service ("Your Content"). You grant us a worldwide, royalty-free licence to host, process, and display Your Content solely to the extent necessary to operate and improve the Service.
You are responsible for Your Content and for ensuring you have the rights to submit it. You represent that Your Content does not infringe any third-party rights.
7. Fees and payment
If the Service is offered on a paid basis, you agree to pay the fees described at the time of purchase or in a separate order form. Fees are non-refundable except as expressly stated. We may change fees with reasonable notice; changes take effect on your next renewal term.
8. Third-party services
The Service may link to or interoperate with third-party services (for example, YouTube, email providers, or authentication services). We are not responsible for those services, and your use of them is governed by their own terms and policies.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any signals, scores, or analyses it produces will be accurate or complete. You use the Service at your own risk and should independently verify any insight before acting on it.
10. Limitation of liability
To the maximum extent permitted by law, in no event will CoStudio Pte Ltd, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim arising out of these Terms or the Service will not exceed the fees you paid us in the twelve (12) months preceding the event giving rise to the claim, or S$100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless CoStudio Pte Ltd from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, violation of these Terms, or infringement of any third-party rights.
12. Term and termination
These Terms apply from the moment you first use the Service and continue until terminated. You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if we believe your use poses a risk to us or other users, or if we discontinue the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will do so.
13. Governing law and disputes
These Terms are governed by the laws of Singapore. Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the courts of Singapore, unless otherwise required by applicable mandatory law.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or through the Service). Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
